Terms & Conditions of Sale
Last updated: [DATE]
These terms govern the sale of goods by [LEGAL BUSINESS NAME] ("we", "us") to you, whether you order through this website, through the Chhaya Cement Centre mobile app, by phone or at our counter. Placing an order means you accept them.
1. Orders
An order you place is an offer to buy. A contract forms only when we confirm the order. We may decline an order if the item is out of stock, if the price or description was wrong, if we cannot deliver to your location, or if we cannot verify your details. If we decline after you have paid, we refund you in full.
2. Prices
Prices are in Indian Rupees and may change at any time without notice, because building material rates move with the market. The price that binds us is the one shown when your order is confirmed. See our Payment Policy.
3. Product information
We describe products as accurately as we can. Photographs are illustrative; packaging and appearance change from batch to batch, and colours vary between screens. Where a product has a technical grade or specification, that grade governs, not the photograph.
4. Quantities and suitability
You are responsible for ordering the right material, grade and quantity for your work. We are happy to advise, and we try to advise well, but any guidance we give is general and does not replace the judgement of your engineer or architect. We are not liable for the consequences of material being wrongly specified by you.
5. Delivery
Delivery is governed by our Shipping Policy. Delivery dates are estimates. Risk in the goods passes to you on delivery; ownership passes once we have been paid in full.
6. Inspection
You must inspect goods at the time of delivery and before signing. Claims for damage, shortage or wrong items must be raised within 48 hours, as set out in our Return Policy.
7. Returns and refunds
See our Return Policy and Refund Policy. Nothing in these terms affects your rights under the Consumer Protection Act, 2019.
8. Storage of materials
Once material is delivered and accepted, how it is stored is your responsibility. Cement in particular must be kept dry and off the ground. We are not liable for material that deteriorates through storage conditions on your site.
9. Manufacturer warranties
Goods carry the warranty, if any, given by their manufacturer. We pass those through to you but do not add to them. Claims against a manufacturer warranty are made against the manufacturer; we will help you raise them.
10. Our liability
Our liability for any order is limited to the value of that order. We are not liable for indirect or consequential loss, including loss of profit, site delay costs, or labour standing idle. Nothing here limits liability for death or personal injury caused by our negligence, or for fraud, or any liability that cannot lawfully be excluded.
11. Events outside our control
We are not in breach of these terms if we are prevented or delayed by something beyond our reasonable control, including weather, flood, strikes, transport disruption, supply failure at source, or action by a public authority.
12. Your account
Keep your password to yourself. You are responsible for orders placed through your account. Tell us at once if you think someone else has used it. See our Terms of Use.
13. Changes
We may update these terms. The version that applies to your order is the one published when you placed it.
14. Governing law
These terms are governed by the laws of India. The courts at [JURISDICTION CITY] have exclusive jurisdiction over any dispute.
